UNAT Held or UNDT Pronouncements
The Tribunal denied the Motion as irreceivable and rejected the Applicant’s request for an extension of time to file his substantive application.
Decision Contested or Judgment/Order Appealed
On 20 June 2025, the Applicant filed a motion with the Dispute Tribunal requesting an extension of time file to file a substantive application challenging the administrative decision dated 18 December 2024, which denied compensation and redress for the Organization’s prolonged delay in processing disability entitlements arising from a catastrophic IED injury sustained in service with MINUSMA on 3 November 2014.
Legal Principle(s)
The Tribunal in determining this application, established the following principles;
- Strict compliance with statutory time limits: UNDT filing deadlines must be strictly observed unless a legally recognized exception applies. A late application is not automatically receivable merely because the underlying claim may have merit.
- Exceptional circumstances must be demonstrated: Under Article 8(3) of the UNDT Statute, an applicant seeking an extension must establish exceptional circumstances. Ordinarily, these must be circumstances beyond the applicant’s control that prevented timely filing.
- Medical impairment must be linked to the delay:Evidence of physical or psychological injury alone is insufficient. The applicant must demonstrate how the condition prevented or materially impaired the ability to file within the prescribed period.
- Staff members are presumed to know applicable rules:The administration is not generally required to provide legal advice to each staff member about procedural deadlines. In this case, the contested decision expressly referred the Applicant to Staff Rule 11.4 and advised him that legal assistance was available.
- Continued administrative engagement does not suspend filing deadlines: Correspondence with the administration, submission of medical updates and follow-up inquiries do not, by themselves, constitute exceptional circumstances justifying an extension. Lack of legal representation is not automatically exceptional: The absence of counsel does not excuse late filing unless the applicant establishes circumstances beyond their control that prevented timely action.
- The Tribunal may raise receivability on its own initiative: The UNDT may examine its competence and the receivability of an application even where the parties have not raised the issue. This principle was supported by 翱’狈别颈濒濒, Judgment No. 2011-UNAT-182, paragraph 31.
- No prejudice to Respondent in this case as a result of failure to serve the motion on Respondent.
