EXAMINATION OF THE MEMORANDUM ON THE PROCEDURE TO BE FOLLOWED IN THE ESTABLISHMENT OF MIXED COMMITTEES (<\/u><\/span>Working Paper W\/46<\/u><\/a>)<\/u><\/span><\/p><\/div>\n

The CHAIRMAN drew the attention of members to<\/span> Document W\/46<\/a> drawn up by the Secretariat at the Commission’s request, and dealing with the Mixed Committees. He personally felt that the document was entirely satisfactory.<\/span><\/p><\/div>\n

\n

Mr. de BOISANGER (France) and Mr. ERALP (Turkey) thought the document set forth very clearly the views expressed at the previous day’s meeting.<\/p><\/div>\n

\n

The PRINCIPAL SECRETARY pointed out that so far the Commission had not drawn up any rules of procedure. Such rules of procedure would obviously be useful to the Chairman as directives to help him to steer the discussions with the necessary method. <\/span>Document W\/46<\/a> prepared by the Secretariat did actually constitute a nucleus of rules of procedure, which might serve as a basis for a more comprehensive text.<\/span><\/p><\/div>\n

The CHAIRMAN agreed that it would be desirable to establish rules of procedure for the Mixed Committees, provided the rules were not too complicated or too inflexible, but consisted merely of general directives for the conduct of business.<\/p><\/div>\n

\n

Replying to Mr. de BOISANGER’s enquiry whether the proposed rules of procedure would simply be adopted by the Commission, or whether the suggestion was to submit them for approval by the parties, the PRINCIPAL SECRETARY said that the document might be submitted for acceptance by the parties concerned.<\/p><\/div>\n

\n

Mr. de BOISANGER (France) wondered whether discussion of the rules of procedure would not give rise to a good deal of argument, which would be of questionable utility and would waste precious time. Would it not be preferable for the Commission itself to adopt the rules of procedure, since its task was to define and steer the course of discussion? Obviously the Commission would notify the parties that it had adopted rules of procedure for the proper conduct of the negotiations.<\/p><\/div>\n

\n

The CHAIRMAN thought Mr. de Boisanger’s suggestion had excellent reasons to commend it, and that the Commission might adopt rules of procedure. The parties would be informed thereof at the opening of negotiations, and of course there would be nothing to prevent them from making comments. In all probability the parties would in fact find it quite normal that for the proper conduct of business a number of very simple and flexible rules should be adopted, as was usual at all such meetings.<\/p><\/div>\n

\n

After some discussion, <\/span>it was decided<\/i><\/span> to ask the Secretariat to draw up draft rules of procedure on the basis of <\/span>document W\/46<\/a>.<\/span><\/p><\/div>\n
