Resolution adopted by the General Assembly<\/strong><\/p><\/div>\n

\n

[without reference to a Main Committee (A\/64\/L.48 and Add.1)<\/i>]<\/p><\/div>\n

\n\t\t\t\t64\/254.\t<\/span>Second follow-up to the report of the United Nations Fact-Finding Mission on the Gaza Conflict <\/strong>\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>The General Assembly<\/i>,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span><\/span>Recalling<\/i><\/span> its relevant resolutions, including resolution 64\/10, adopted on 5 November 2009, in follow-up to the report of the United Nations Fact-Finding Mission on the Gaza Conflict,<\/span>1<\/sup><\/span>\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span><\/span>Recalling also<\/i><\/span> the relevant rules and principles of international law, including international humanitarian and human rights law, in particular the Geneva Convention relative to the Protection of Civilian Persons in Time of War, of 12 August 1949,<\/span>2<\/sup><\/span> which is applicable to the Occupied Palestinian Territory, including East Jerusalem,<\/span>\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span><\/span>Recalling further <\/i><\/span>the Universal Declaration of Human Rights<\/span>3<\/sup><\/span> <\/sup><\/span>and the other human rights covenants, including the International Covenant on Civil and Political Rights,<\/span>4<\/sup><\/span> the International Covenant on Economic, Social and Cultural Rights<\/span>4<\/sup><\/span> and the Convention on the Rights of the Child,<\/span>5<\/sup><\/span> <\/sup><\/span>\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Reaffirming<\/i> the obligation of all parties to respect international humanitarian law and international human rights law,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Reiterating<\/i> the importance of the safety and well-being of all civilians, and reaffirming the obligations under international law regarding the protection of civilians in armed conflict,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Stressing<\/i> the need to ensure accountability for all violations of international humanitarian law and international human rights law in order to prevent impunity, ensure justice, deter further violations and promote peace,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Convinced<\/i> that achieving a just, lasting and comprehensive settlement of the question of Palestine, the core of the Arab-Israeli conflict, is imperative for the attainment of a comprehensive, just and lasting peace and stability in the Middle East,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>1.\t<\/span><\/span>Takes note<\/i><\/span> of the report of the Secretary-General of 4 February 2010,<\/span>6<\/sup><\/span> <\/sup><\/span>submitted pursuant to paragraph 6 of its resolution 64\/10;<\/span>\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>2.\t<\/span>Reiterates<\/i> its call upon<\/i> the Government of Israel to conduct investigations that are independent, credible and in conformity with international standards into the serious violations of international humanitarian and international human rights law reported by the United Nations Fact-Finding Mission on the Gaza Conflict, towards ensuring accountability and justice;\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>3.\t<\/span>Reiterates its urging<\/i> for the conduct by the Palestinian side of investigations that are independent, credible and in conformity with international standards into the serious violations of international humanitarian and international human rights law reported by the Fact-Finding Mission, towards ensuring accountability and justice;\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>4.\t<\/span><\/span>Reiterates its recommendation<\/i><\/span> to the Government of Switzerland, in its capacity as depositary of the Geneva Convention relative to the Protection of Civilian Persons in Time of War,<\/span>2<\/sup><\/span> to reconvene as soon as possible a Conference of High Contracting Parties to the Fourth Geneva Convention on measures to enforce the Convention in the Occupied Palestinian Territory, including East Jerusalem, and to ensure its respect in accordance with article 1, bearing in mind the convening of such a Conference and the statement adopted on 15 July 1999 as well as the reconvening of the Conference and the declaration adopted on 5 December 2001;<\/span>\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>5.\t<\/span>Requests<\/i> the Secretary-General to report to the General Assembly, within a period of five months, on the implementation of the present resolution, with a view to the consideration of further action, if necessary, by the relevant United Nations organs and bodies, including the Security Council;\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>6.\t<\/span>Decides<\/i> to remain seized of the matter.\n\t\t\t\t<\/div>\n
