UNAT held that UNDT correctly concluded that the Appellant¡¯s claim was not receivable. UNAT noted that it was evident that the Appellant knew of the process of management evaluation at the time of the impugned administrative decision. UNAT also held that UNDT correctly exercised its discretion to award costs against the Appellant for abuse of the judicial process, as her failure to apply for management evaluation was deliberate and thus her application was frivolous and vexatious. UNAT dismissed the appeal in its entirety and affirmed the UNDT judgment.

UNAT preliminarily denied the Appellant¡¯s motion to submit an amicus curiae brief. On the merits, UNAT noted that the Board of Examiners found the Appellant to be one of 68 applicants who, although meeting the minimum requirements, were not deemed the most qualified and therefore not convoked to the examination. UNAT held that the appeal did not identify any errors in the reasoning of UNDT and found no basis for disagreeing with UNDT. UNAT dismissed the appeal and upheld the UNDT judgment.

UNAT considered the Secretary-General¡¯s appeal regarding the judgment on Receivability (UNDT/2011/063) and the judgment on the Merits (UNDT/2010/085). As a preliminary matter, UNAT denied Ms Hunt-Matthews' request for an oral hearing. UNAT noted that the Secretary-General may properly appeal the judgment on Receivability as part of the judgment on the Merits and that it was timely. UNAT considered whether UNDT should have received Ms Hunt-Matthes¡¯ application and found that it was not receivable ratione materiae. UNAT found that UNDT erred when it determined that Ms Hunt-Matthes¡¯ claims of...

UNAT held that, while the representatives of the parties were present at the oral proceedings, they are entitled to the record of the testimonies made at those proceedings from the relevant UNDT Registry. UNAT held that this record is critical for the preparation of the appeal case. UNAT held that the transcripts of the testimonies of seven out of 17 witnesses were missing. UNAT held that the Appellant was entitled to the record of the testimonies critical to the preparation of the appeal case, applying its jurisprudence in Finnis (Order No. 49 (2011)). UNAT upheld the appeal, vacated the UNDT...

UNAT considered both an application for Revision of judgment No. 2013-UNAT-311 and a motion for confidentiality filed by Mr Pirnea. On the application for revision of judgment, UNAT held that Mr Pirnea did not set forth a new fact that was unknown to both him and UNAT at the time the judgment was rendered. Thus, his application did not come within the grounds for revision set forth in Article 11(1) of the UNAT Statute and Article 24 of the UNAT Rules of Procedure. On the motion for confidentiality, UNAT noted that the motion was late, and it was unlikely that confidentiality could be achieved...

UNAT considered two appeals by the staff member of UNDT Order Nos. 109 and 110. UNAT held that the appeals were receivable because they were addressed against judicial decisions which disposed the cases before UNDT. Finding that the two appeals raised the same legal issues, UNAT consolidated them in the interest of judicial economy and consistency. UNAT held that there was no merit in the Secretary-General¡¯s observations about the non-receivability of the appeals. UNAT held, however, that the motions for reinstatement were in fact non-receivable ab initio. UNAT held that there was no statutory...

UNAT considered an appeal by the Secretary-General. UNAT held that UNDT had erred in deciding that the non-renewal of the staff member¡¯s contract was unlawful. UNAT held that the staff member was aware that a high school diploma was an essential qualification. UNAT held that his contract was conditional upon him producing proof of this qualification. UNAT noted that the staff member was also aware that the consequence of failing to satisfy this requirement was the non-renewal of his contract. UNAT agreed with the Secretary-General¡¯s submission that the decision not to renew was neither...

UNAT considered an appeal by the staff member and a cross-appeal by the Secretary-General. Regarding the cross-appeal of the Secretary-General on material damages, UNAT held that UNDT was the body best placed to assess a candidate¡¯s chance of selection for placement on the roster. UNAT held that the fact that there were several candidates selected from the roster in the months following the roster approval was sufficient to underpin UNDT¡¯s assessment that the staff member¡¯s chances were not in the realm of the speculative. UNAT held that there was no merit in the Secretary-General¡¯s cross...

The Appellant filed a notice of withdrawal pursuant to the terms and conditions of a settlement agreement. UNAT issued Order No. 188 (2014) noting the withdrawal and ordering the Registrar to close the case.

UNAT considered an appeal by the Secretary-General. UNAT noted that it was not disputed that the evidence given by Mr Verwey (a witness called by the staff member) regarding the alleged falsification of allegations of breach of confidentiality by the staff member¡¯s former supervisor and the former Deputy Inspector-General, was not disclosed in Mr Verwey¡¯s summary of evidence. UNAT held that UNDT erred in not attaching any importance to this omission. UNAT held that the summary that was provided was vastly different from the oral evidence given by Mr Verwey. UNAT held that the Secretary-General...
