UNAT considered a request for revision of judgment No. 2014-UNAT-436 as well as a motion requesting that UNAT strike certain paragraphs from it. UNAT held that the request did not fulfil the statutory requirements and constituted, in fact, a disguised attempt to re-open the case. UNAT held that his application was not receivable. UNAT dismissed the application for revision.
UNAT held that, while it may be argued that the Appellant did not request her transfer to Amman, she consented to it, and the transfer was effected for her personal convenience. UNAT held that the text of UNRWA Area Staff Rule 107. 9 was clear and that UNRWA DT correctly concluded that she was not entitled to the payment which she sought. UNAT held that, contrary to the Appellant’s submissions, UNRWA DT did not exclude her evidence. Recalling the broad discretion of UNRWA DT to ascertain the weight to attach to the evidence before it, UNAT noted that UNRWA found that the Appellant’s evidence...
UNAT noted that the Appellant was not bringing a claim that he did not receive the benefits and entitlements which pertained to a temporary appointment, but rather his allegation was that the General Assembly resolutions which gave rise to the rules and administrative issuances regulating his employment did not adhere to the principle of equal pay for equal work and were contrary to a myriad of international human rights instruments to which the Organisation was bound to adhere. UNAT held that the policy change for staff members on temporary contracts was binding on the Secretary-General, who...
UNAT considered an appeal by the Secretary-General. UNAT held that the decision to set up a fact-finding panel was not, in and of itself, a decision relating to the contractual rights of a staff member. UNAT held that such a decision was preliminary in nature and irregularities in connection with that decision, including alleged delay in reaching that decision, may only be challenged in the context of an appeal after the conclusion of the entire process. UNAT held that UNDT’s conclusion that the application was receivable was without legal basis as was its award of compensation. UNAT held that...
UNAT considered an appeal by the Secretary-General. UNAT affirmed, albeit on different grounds, the UNDT award of compensation to Mr Pirraku. UNAT observed that the issues surrounding Mr Pirraku’s non-promotion should not have been presented to, or addressed by, UNDT. UNAT held that the issues regarding Mr Pirraku’s non-promotion were the subject of a settlement and release agreement reached through mediation and, as such, were not subject to judicial review. UNAT held that the issue for UNDT’s determination was the execution of the settlement agreement. UNAT held that the issues of...
UNAT held, in agreement with UNDT, that the decision of 23 April 2013 when the Appellant was informed that his post would be abolished on 31 December 2013, constituted the contested administrative decision in the case. UNAT agreed with the Appellant that, in its Order No. 98 (NY/2014), UNDT made no reference to considering receivability as a preliminary issue, however, UNAT held that the Appellant did not establish that such an error resulted in a manifestly unreasonable decision or had any effect at all on the decision. UNAT held that the Appellant’s claim that he did not receive a fair trial...
UNAT considered an appeal by the Secretary-General and a cross-appeal by Mr Kouadio. UNAT noted that at no point did Mr Kouadio request management evaluation of the contested decision and that UNDT is prohibited from considering any application brought to it more than three years after the issuance of the administrative decision that a potential applicant is seeking to challenge. UNAT held that the UNDT erred on a question of law in finding that it could not determine the receivability of the application. UNAT upheld the Secretary-General’s appeal, vacated the UNDT judgment and dismissed Mr...
UNAT held that the evidence against the Appellant uncovered by the investigation was so overwhelming that the only reasonable conclusion available to UNDT was that the facts were established by clear and convincing evidence. Noting that the evidence that he was in possession of the stolen card and that he used it to refuel his own private vehicle was not contested by the Appellant, UNAT held that his explanation of how he came into possession of the stolen card and how he came to use it was incapable of belief. UNAT agreed with the finding of UNDT that the established facts amounted to serious...
UNAT held that the Secretary-General was duty-bound to implement decisions by the ICSC as directed by the General Assembly and that for the most part, such decisions are of general application and therefore not reviewable. UNAT held, however, that where a decision of general application negatively affects the terms of appointment of a staff member, such decision shall be treated as an “administrative decision” within the scope of Article 2. 1 of the UNDT Statute. Based on the staff member’s Personnel Action Forms, before and after implementation of the ICSC’s renumbering exercise, UNAT held...
Noting that that the crux of the Appellant’s appeal was that UNDT erred in failing to award him moral damages by reason of the violation of his right to a fair recruitment process and a missed opportunity, UNAT held there was merit to the appeal. UNAT held that there was no evidence that the Appellant’s claim for moral damages was properly considered by UNDT. UNAT held that on the totality of the evidence, the Appellant had a claim for moral damages. UNAT upheld UNDT’s finding that the recruitment process was flawed in that it was affected by the perception of bias. UNAT granted the appeal in...
