UNAT considered Mr Wang¡¯s appeal, specifically as to whether UNDT correctly concluded that the selected candidate, Ms C. Y., fulfilled the requirements for the post and whether UNDT correctly concluded that Mr Wang was accorded full and fair consideration in the selection process for the post. UNAT was satisfied that the evidence before UNDT supported the Administration¡¯s decision to select Ms C. Y. for the post. UNAT found that there was sufficient evidence that Ms C. Y. had the requisite word count translation requirement and that the Administration gave her proportionate credit for her...

UNAT considered the Commissioner-General¡¯s appeal, which alleged that UNRWA DT erred in finding that the UNRWA Administration¡¯s decision not to inform Mr Hamayel that his post would not be held for him during his second year of Special Leave Without Pay (SLWOP) was arbitrary and unreasonable, thereby vitiating the decision to transfer Mr Hamayel, and by awarding moral damages. UNAT found that it was both logical and reasonable to expect the UNRWA Administration to inform Mr Hamayel that taking a second year of SLWOP would cause him to lose his post. UNAT noted that, even though Mr Hamayel had...

UNAT considered Ms Dzuverovic¡¯s Application for Interpretation of judgment, specifically the portion that dismissed the Secretary-General¡¯s cross-appeal to redact the recommendations made by UNDT and thus allowed them to remain despite the fact that Ms Dzuverovic¡¯s UNDT application was not receivable. UNAT held that it explained the meaning and scope of its decision to dismiss the Secretary-General¡¯s cross-appeal and not to redact the UNDT recommendations when it stated that the recommendations had no binding consequences on the parties. UNAT found that the judgment was not ambiguous and...

UNAT acknowledged that while the Appellant was eligible for a permanent appointment, the Administration was entitled to have regard to the fact that she was recruited because she was a national of Romania for the specific post in UNIC Bucharest. UNAT noted that both the Department of Public Information and the Officer-in-Charge of Human Resources Services previously anticipated that UNIC Bucharest, among others, was scheduled to close in the very near future, due to the uncertainty of the funding by the host country, on which the continuation of the Appellant¡¯s post depended. UNAT noted that...

UNAT considered the Secretary-General's appeal of judgment on Receivability No. UNDT/2013/061 and of judgment on the Merits No. UNDT/2013/101. UNAT held that the appeal of the judgment on Receivability was timely. UNAT found that UNDT erred in finding that Mr Ngokeng¡¯s satisfactory appraisal constituted an appealable administrative decision, as there was no evidence of any adverse administrative decision stemming from Mr Ngokeng¡¯s performance appraisal. UNAT specifically noted that the First Reporting Officer¡¯s comment on Mr Ngokeng¡¯s output did not detract from the overall satisfactory...

The Secretary-General appealed UNDT¡¯s decision to admit to judicial review Ms Al-Badri's challenge against the decision to abolish her post in Amman and to create a new post at the same level in Baghdad. UNAT only considered the receivability of this appeal. UNAT held that alleged excess of jurisdiction or competence on the part of UNDT, so as to admit an appeal of an interlocutory order or judgment, must be clear or manifest. UNAT recalled its jurisprudence that the general principle underlying the right of appeal set out in Article 2(1) of the UNAT Statute is that only final judgments of...

The first issue UNAT considered was whether UNDT erred in applying ST/AI/2010/3 to the selection of staff for the G-7 post and UNAT found that UNDT did not err in this regard. UNAT noted that the language of paragraph 14 of the Memorandum of Understanding With Respect to United Nations Personnel Procedures Application to the UN Joint Staff Pension Fund requires that ¡°[t]he General Service staff of the [Pension] Fund secretariat shall be appointed and promoted through the normal [United Nations appointment and promotion] procedures, according to the policies applicable at the duty stations in...

UNAT held that UNDT correctly concluded that the Appellant¡¯s claim was not receivable. UNAT noted that it was evident that the Appellant knew of the process of management evaluation at the time of the impugned administrative decision. UNAT also held that UNDT correctly exercised its discretion to award costs against the Appellant for abuse of the judicial process, as her failure to apply for management evaluation was deliberate and thus her application was frivolous and vexatious. UNAT dismissed the appeal in its entirety and affirmed the UNDT judgment.

UNAT preliminarily denied the Appellant¡¯s motion to submit an amicus curiae brief. On the merits, UNAT noted that the Board of Examiners found the Appellant to be one of 68 applicants who, although meeting the minimum requirements, were not deemed the most qualified and therefore not convoked to the examination. UNAT held that the appeal did not identify any errors in the reasoning of UNDT and found no basis for disagreeing with UNDT. UNAT dismissed the appeal and upheld the UNDT judgment.

As a preliminary matter, UNAT dismissed the Appellant¡¯s request for an oral hearing. On the merits, UNAT noted that he argued the same arguments that he put before UNRWA DT. UNAT found that UNRWA DT gave careful and fair consideration to the Appellant¡¯s arguments and weighed them against the facts of the case. UNAT found no fault with UNRWA DT¡¯s decision and held that the Appellant did not demonstrate that UNRWA DT erred in fact or law. UNAT dismissed the appeal and affirmed the UNRWA DT judgment.
