On the Appellant¡¯s complaint that the non-selection decision was tainted by procedural irregularity and bias, UNAT noted that the presence of two directors from the Education Department on the interview panel did not offend UNRWA¡¯s regulatory framework. UNAT held that it was possible to infer reasonably from the interview panel¡¯s analysis and its sympathetic view of the Appellant that, on the probabilities, it was not prejudiced against her on the basis alleged. UNAT held that it was evident from the seniority of the position and the role that the incumbent of the post would be required to...

UNAT held that the Appellant¡¯s case was fully and fairly considered by UNRWA DT. UNAT found no error of law in UNRWA DT¡¯s decision. UNAT held that UNRWA DT properly reviewed the contested decision in accordance with the applicable law. UNAT held that the non-extension of the limited duration contract was a result of the elimination of her post due to a lack of funds, which constituted a valid reason proffered by the Administration for not renewing her appointment. UNAT held that, by applying objective criteria in the reduction of the staffing levels, UNRWA adhered to the principles of equality...

UNAT noted that in the absence of a university degree, the Appellant did not satisfy the academic criterion stated in the vacancy announcement, but he was long-listed, which meant that UNRWA took his experience into consideration and decided that his additional years of experience justified his pre-selection. UNAT held that UNRWA DT erred in fact in considering that UNRWA did not examine whether the experience of the Appellant could offset his lack of a university degree. UNAT held that the decision by UNRWA to limit the short-list to seven candidates with university degrees was reasonable and...

UNAT held that the staff member had not voluntarily absented himself from duty. Rather, he reported for duty throughout at the office he had been re-assigned to, his whereabouts were known to the Agency and he clearly did not intend to abandon his position. As to the staff member¡¯s refusal to report to his original position as instructed, UNAT held that his conduct might have been a performance or conduct issue open to censure or discipline. However, UNAT held that the Agency failed to determine if the conduct constituted insubordination and, if so, a proportional sanction. Instead, UNAT held...

Noting that the position in question remained vacant, UNAT held that the decision to leave the position vacant was an exercise of the discretionary authority of UNRWA DT and that there was no procedural irregularity or error of law within the exercise of that discretion. UNAT held that the Appellant did not meet the required burden to be heard on appeal, namely, he failed to identify any of the prescribed grounds of appeal. UNAT held that the Appellant was estopped from raising new arguments on appeal with respect to priority consideration and facts on enrolment which were not argued before...

UNAT held that while the UNRWA DT decision could have had an indirect impact on the Appellant¡¯s terms of appointment or contract, a direct effect is needed in order to allow a staff member to contest an adverse administrative decision. UNAT held that the fact that UNRWA granted the change of modality of contract to the other individual did not have any bearing on the outcome of the UNRWA DT decision, because the application was dismissed on receivability grounds. UNAT held that UNRWA DT did not err in any of its factual findings resulting in a manifestly unreasonable decision. UNAT held that...

UNAT held that the first time the Appellant¡¯s claim for implementation of the sanction (an apology to the Appellant) was raised was on appeal and that it was therefore not receivable, however, UNAT held that the Appellant was not barred from requesting UNRWA to enforce its letter of censure. On the Appellant¡¯s claim for moral damages, UNAT found no error in UNRWA DT¡¯s order denying the Appellant¡¯s request for moral damages since there was no evidence of harm. UNAT dismissed the appeal and affirmed the UNRWA DT judgment.

UNAT held that UNRWA DT committed an error of fact in stating that the OPT Allowance was paid in local currency, which led UNRWA DT to commit an error of law in stating that Area Staff Circular No. A/04/2014 was applicable. UNAT held that Area Staff Circular No. A/04/2014 was only applicable to the Jerusalem Allowance and not the OPT Allowance, which was paid in US Dollars. UNAT held that such an error of law would be inconsequential if its second line of reasoning, that no rule or policy requires the CAF be applied to the OPT Allowance, was correct. UNAT held that there was no rule requiring...

UNAT rejected the UNRWA Commissioner-General's submission that the appeal was defective because it failed to identify any of the grounds of appeal prescribed by Article 2(1) of the UNAT Statute. UNAT held that the Appellant¡¯s ground of appeal was without merit. UNAT held that the Commissioner-General was obliged to calculate the Appellant¡¯s retirement benefits in accordance with the new Staff Rule and did so correctly. UNAT held that UNRWA DT did not commit any error of fact and law in arriving at its decision. UNAT dismissed the appeal and affirmed the UNRWA DT judgment.

With respect to the Appellant¡¯s appeal as it pertained to his 2016 performance evaluation and OTI, UNAT held that UNRWA DT did not err on a question of law or fact resulting in a manifestly unreasonable decision, nor did it commit an error in procedure such as to affect the outcome of the case. UNAT held that the issue of the e-PERs of the other staff members was not raised before UNRWA DT and, therefore, was not receivable. UNAT held that the reopening of the 2016 e-PER did not affect the overall performance evaluation, which was maintained as ¡°fully meets¡± expectations, and therefore this...
