UNAT had before it an appeal of judgment No. UNRWA/DT/2014/017. UNAT noted that judgment No. 2013-UNAT-963 was a final judgment and therefore the Appellant¡¯s case was res judicata, which meant that the Appellant was precluded from raising his claim again. UNAT held that UNRWA DT made no error in finding the Appellant¡¯s application manifestly inadmissible and dismissing it without referring it to the Commissioner-General. UNAT held as unsustainable the Appellant¡¯s claim that UNRWA DT erred in law when it considered his application was an application against judgment No. 2013-UNAT-363. UNAT held...

UNAT held that it was satisfied that the rejection of the application as not receivable was correct on the basis that the Appellant did not seek decision review within the mandatory time period, which meant that UNRWA DT was precluded in law from considering the merits of his application. UNAT held that the Appellant did not identify how the UNRWA DT judgment was in any way defective or demonstrated that UNRWA DT erred in relation to its jurisdiction or committed an error of fact or law or procedure such as would warrant intervention by UNAT. UNAT dismissed the appeal and affirmed the UNRWA DT...

UNAT held that there was no error in the UNRWA DT decision that the Appellant did not challenge a discretionary administrative decision that breached the terms of his appointment, rather, he was challenging the rule providing for the manner in which separation benefits should be calculated, including the applicable interest rate. UNAT held that the Appellant did not challenge an appealable administrative decision in that he did not contest a unilateral decision taken by the administration in a precise individual case. UNAT held that UNRWA DT correctly held that the publication of interest...

The Appellant appealed the UNRWA DT judgment failure to consider several points and to address compensation. UNAT held that the Appellant did not identify any of the requisite grounds in his appeal. UNAT held that it would not allow new claims to be raised on appeal when the circumstances giving rise to such claims were known to a party at the time and should have been presented to UNRWA DT. UNAT upheld the UNRWA DT¡¯s decision not to award compensation on the basis that there was no evidence in support of the Appellant¡¯s claim of psychological suffering. UNAT held that the Appellant¡¯s case was...

UNAT considered an appeal by the Commissioner-General. UNAT held that UNRWA DT set out the correct legal framework, but thereafter erroneously reviewed the evidence and interfered with the administrative discretion, since UNRWA had established the misconduct by clear and convincing evidence. UNAT held that UNRWA DT erred in law in its evaluation of the evidence and that UNRWA had established the existence of the facts warranting disciplinary sanction. UNAT held that the procedure and the subsequent decision were lawful and there was no basis to rescind the termination or to award any...

UNAT considered an appeal of judgment Nos. UNRWA/DT/2013/035 and UNRWA/DT/2014/004. UNAT held that there was no basis to support the Appellant¡¯s claim of legitimate expectations and/or rights for the renewal of his contract. UNAT held that the Appellant failed to demonstrate that UNRWA DT erred with respect to the amount awarded for al damages. UNAT held that UNRWA DT evaluated all the evidence before it and made a reasoned assessment as to the amount of anxiety and stress suffered by the Appellant. UNAT held that it would not lightly interfere with the determination of UNRWA DT. UNAT held...

UNAT considered an appeal by the Commissioner-General of the order rescinding the decision to transfer the Appellant and the moral damages award. On the Commissioner-General¡¯s argument that UNDT unduly fettered its discretion to award compensation in lieu of specific performance, UNAT held that, absent any error of law or manifestly unreasonable factual findings, which were not evident, UNAT would not interfere with the discretion vested in UNRWA DT to decide on remedy. UNAT held that, in all of the circumstances of the case, it was not persuaded by the Commissioner-General¡¯s argument that...

UNAT held that UNDT correctly determined that it did not have jurisdiction to review the decision to suspend him without pay. UNAT held that UNDT was alert to the injury which the prolonged delay caused the Appellant. On the Appellant¡¯s complaint that UNRWA DT did not address his complaint regarding the deduction by UNRWA from his personal Provident Fund contributions upon his dismissal, apparently, to recoup an overpayment, UNAT held that there was no merit in the complaint and the Appellant failed to demonstrate any error of law or fact on the part of the UNRWA DT when it determined these...

UNAT held that the Appellant raised the same issues he raised before UNRWA DT and did not identify how the judgment was in any way defective. UNAT held that the Appellant did not identify any of the required grounds of appeal and failed to demonstrate that UNRWA DT committed any error of fact or law in arriving at its decision. UNAT held that the Appellant¡¯s case was fully and fairly considered by UNRWA DT and found no error of law or fact in its decision. UNAT dismissed the appeal and affirmed the UNRWA DT judgment.

UNAT held that, in protesting against the non-inclusion of his Transitional Personal Allowance in his retirement benefit, the Appellant had failed to appreciate the distinction between an allowance and base salary. UNAT held that UNRWA DT correctly found that under the applicable Staff Rules, the Appellant¡¯s retirement benefit did not include the Transitional Personal Allowance. UNAT found no error in the UNRWA DT¡¯s finding that the Appellant had not submitted a timely request for decision review with respect to his allegation of impropriety of his transfer and that therefore that claim was...
