UNAT considered an appeal by the Secretary-General. UNAT held that the reasons proffered by the Administration for not renewing Mr Pirnea¡¯s appointment were valid, namely that he could no longer perform his functions in Somalia since his life was at risk there. UNAT held that the UNDT¡¯s conclusion that the Administration had hidden reasons for not renewing Mr Pirnea¡¯s appointment was based solely on speculation and that UNDT erred on a question of law and fact resulting in a manifestly unreasonable decision when it concluded that there was no valid reason for the non-renewal. UNAT noted that...

UNAT considered an appeal by the Secretary-General and a cross-appeal by Ms. Asariotis. Considering first the cross-appeal, UNAT found no merit in the ground of appeal related to claimed errors in procedure on the part of UNDT. UNAT held that UNDT¡¯s failure to deal specifically with certain issues, namely the benefits Ms. Asariotis lost and priority that would have been afforded to her as a female candidate, did not manifestly affect the outcome of the case, in view of the UNDT¡¯s conclusion that the decision to cancel the vacancy announcement was lawful. UNAT held that UNDT was correct in...

UNAT considered an appeal by the Secretary-General. UNAT recalled that UNAT expressly held in Mmata (judgment No. 2010-UNAT-092) that Article 10. 5 of the UNDT Statute limited the total of all compensation to the equivalent of two years¡¯ net base salary of the applicant, unless higher compensation was warranted and reasons were given to explain what makes the case exceptional. UNAT noted that the case was exceptional, including a series of orders for suspension of action, findings of fact pointing to evidence of abuse of authority, retaliatory threats, and a hostile and offensive environment...

UNAT held that concern about a high-level manager¡¯s poor performance was not an improper motive or basis for the decision not to renew a fixed-term appointment. UNAT noted that it was well within the discretion of UNDT to determine the amount of compensation for moral damages to award a staff member for procedural violations in light of the unique circumstances of each case. UNAT held that the cases cited by the Appellant as examples of higher awards were neither applicable nor persuasive. UNAT held that UNDT did not err in awarding moral damages of USD 25,000. UNAT held there was no merit in...

UNAT considered an appeal by the Secretary-General. UNAT held that there was no nexus between the emotional distress of preparing for the exam and the impugned decision as the preparation took place prior to the decision. UNAT held that UNDT¡¯s finding that the contradictory information received by Ms Mirkovic and the lack of responses from the Chief of the Examinations and Tests Section added to her stress and injury was not supported by the facts, noting that written confirmation of what the Chief had told her was not required in order for her to request management evaluation. UNAT held that...

UNAT considered an appeal by the Secretary-General. UNAT held that UNDT erred in law and exceeded its competence by awarding compensation for distress without a previous claim for damages. UNAT noted that Mr Debebe¡¯s claim before the Joint Appeals Board (JAB) had been limited to material or pecuniary damages related solely to remuneration. UNAT held that UNDT did not have jurisdiction to award compensation for moral damage. UNAT allowed the appeal and vacated the UNDT judgment to the extent that it awarded compensation for moral damages.

On the issue of the UNDT¡¯s decision not to take up the Appellant¡¯s motion for disclosure of documents, UNAT held that the Appellant failed to demonstrate how this affected his rights or would have had a relevant impact on the evidence already collected, the basic facts of which were not contested, and therefore UNAT held there were no procedural grounds to vacate the judgment. On the merits, UNAT held that the Appellant had not established any error of fact or law that warranted reversal of the judgment. UNAT recalled that not every violation of due process led to an award of compensation...

UNAT considered an appeal by the Secretary-General. UNAT held that UNDT had correctly stated that even if it could be argued that the profile of the Broadcast Technology Officer (BTO P-4) post had changed due to the drafting of new Terms of Reference (TOR) by Ms Hermann, the only viable course of action in the circumstances for the purposes of filling it would have been a regular, competitive selection process and not a comparative review as happened in this case. UNAT held that UNDT was correct in finding that the so-called comparative review between Ms Hersh and Mr Tobgyal for the only post...

UNAT considered an application for interpretation by Mr Shkurtaj on the issue of interest. UNAT referred to Warren (judgment No. 2010-UNAT-059) and Mmata (judgment No. 2010-UNAT-092) for the holding that interest was to be paid at the US Prime rate from the date on which the entitlement became due. UNAT held that the interest payable was at the US Prime Rate and that an extra five per cent should be added to the US Prime Rate if the judgment was not executed within 60 days of its issuance. UNAT held that the date from which interest on the compensation was to be paid at the US Prime Rate was...

On the alleged procedural error of the UNDT not allowing an oral examination of witnesses, UNAT held that it was well within the competence of UNDT to manage its cases as it saw fit and that the Appellant had not demonstrated how the procedure affected or violated her due process rights; UNAT dismissed this ground of appeal. UNAT held, affirming the finding of UNDT, that the Appellant failed to establish that the decision to remove her from her post in Budapest constituted a disguised disciplinary measure. UNAT found no merit in the ground of appeal that UNDT failed to consider that UNHCR...
