The UNAT held that the former staff member¡¯s challenge to the ALWP decision and the New York position decision was not receivable, as she had not sought management evaluation of those decisions.

Regarding the disciplinary measure, the UNAT determined that her statements and social media posts constituted unauthorized outside activities amounting to misconduct. It noted that she issued statements, posted articles, and gave interviews without prior authorization, despite repeated warnings. It held that her social media engagements referenced international humanitarian assistance, humanitarian...

The UNAT held that the UNDT did not err in concluding that the former staff member¡¯s application was not receivable ratione materiae because he did not attempt to resolve the dispute through the office of the United Nations Funds and Programmes Ombudsman, as explicitly required by the Settlement Agreement to which he had expressly agreed. The UNAT found that the terms of the Settlement Agreement remained binding and enforceable on the parties, and that the UNDT committed no error in holding the parties to its terms.

The UNAT further found that the UNDT did not err in determining that the...

The UNAT rejected the former staff member¡¯s motion for anonymity, as it was filed out of time and without exceptional circumstances justifying a waiver of the time limit.

The UNAT found that the UNRWA DT did not err in concluding that the former staff member¡¯s application was not receivable. The 60-day period within which she had to submit a request for decision review (RDR) began on 13 September 2023 and ended on 11 November 2023. As her RDR was lodged (i.e., received by the Agency) late on 11 November 2023, it was lodged within the statutory time limit. However, in the absence of a...

The UNAT affirmed the UNDT¡¯s decision to dismiss the former staff member¡¯s request for anonymity, as he had ignored the deadline set by the UNDT in an Order.

The UNAT found that the former staff member committed sexual exploitation by engaging in a romantic and sexual relationship with a vulnerable refugee, who put herself in danger in engaging in a premarital relationship with him. He abused his position of trust by promising to marry her to persuade her to have sexual relations with him. When she pushed him about his promises, he threatened her with an investigation that could result in the...

The UNAT found that beyond reporting the possible prohibited conduct concerning non-compliance with the United Nations financial rules and regulations to the Office of Internal Oversight Services, the staff member had no further interest in law in the conduct of the investigation or its outcome. The UNAT further agreed with the UNDT that there was no basis for his assertion that OIOS had declined to conduct an investigation into his report. The UNAT concluded that the UNDT had not erred in finding the application concerning this decision not receivable.

Regarding the staff member¡¯s complaint of...

The UNAT held that the facts were established by clear and convincing evidence. It held that the Complainant¡¯s testimony was consistent with her earlier statements, except for the date of the incident. However, the correction of the date she made at the hearing was found to be in good faith and did not undermine her credibility. Her account was corroborated by two other staff members, M.V. and M.M., both of whom testified before the UNDT. The UNAT also held that the former staff member failed to show that these witnesses had any motive to falsely implicate him. It noted that the former...

The UNAT held that the creation of the position of Deputy Special Representative (DSR), undertaken as part of the implementation of the recommendations to restructure the oPt Office, constituted an administrative decision of a general nature. It further concluded that although the newly established ToR for the DSR position transferred to the incumbent some duties and responsibilities that were previously part of the staff member¡¯s Terms of Reference (ToR), this reallocation alone was insufficient to conclude that the creation of the position of DSR produced direct legal consequences for the...

The UNAT held that the Administration¡¯s restructuring of the finance function was a genuine exercise and a proper use of the Administration¡¯s discretion in responding to evolving needs. The UNAT did not agree that the Administration acted unfairly or unjustly in abolishing the former staff member¡¯s post. The UNAT further held that consultation with the former staff member was not required prior to the abolition of her post.

The UNAT found that the former staff member¡¯s dissatisfaction with the UNDT¡¯s assessment of the evidence of workplace issues between her and her supervisor does not...

The UNAT held that the staff member bore the burden of proving that the Secretary-General¡¯s failures to address both the discriminatory policies of the host country and the alleged attempt of the law enforcement authorities of that host country to recruit him, constituted unilateral decisions taken by the Administration, which applied to him individually, and had direct legal consequences on his terms of appointment or contract of employment. The UNAT held that the staff member could not meet this burden because these issues fell within the realm of diplomacy, are subject to the rules of...

The UNAT held that the staff member¡¯s motion for recusal of the UNAT Registrar had no merit. The UNAT noted that the decision to administratively close the case had been taken by the UNAT President and communicated to the parties as such by the UNAT Registrar in her letter. The UNAT found that it followed from the administrative closure of a case that parties no longer had the right to access the Court Case Management System under the case number in question. The UNAT held that the UNAT Registrar¡¯s decisions to reject as manifestly inadmissible the staff member¡¯s filings following the case...
